In a significant legal decision, a federal judge in Tacoma, Washington, has ordered the arrest of the YM SUMES, a boxship owned by Yang Ming Marine Transport, due to an ongoing dispute concerning an unpaid fuel bill from OW Bunker. The ruling was issued by District Judge Benjamin Settle following a lawsuit filed by Bunker Holdings, the fuel supplier seeking the vessel's seizure. This case is part of a broader legal landscape where various lawsuits have emerged in the United States linked to fuel purchases made via OW Bunker and its affiliates prior to the company's liquidation in Denmark. However, Bunker Holdings' case specifically involves fuel that was supplied a month after the Danish company’s downfall, detailing a transaction connected to a Singapore-based OW entity. According to the lawsuit, Bunker Holdings was contracted by OW Bunker Far East on December 8th to deliver bunkers to the post-panamax YM Success at Nadhodka, Russia. Subsequently, Bunker Holdings contracted Baltic Tanker for the transportation of the fuel to the containership. As it stands, Bunker Holdings claims that the payment of $1.89 million for the fuel remains outstanding. Yang Ming, headquartered in Taiwan, has not yet commented on the situation.
