Detainment of Bulk Carrier 'The Patron' After Engine Failure Leads to Legal Battle

Dec 30, 2025 00:04

In a significant legal development, the Orissa High Court has ordered the detainment of the bulk carrier 'The Patron' near Paradip Port. This action follows an urgent admiralty suit filed by JALDHI Overseas Pte Ltd, based in Singapore, which is seeking $202,000 in recovery. The pressing need for judicial intervention arose when the plaintiff's legal counsel expressed concerns about the vessel potentially departing Indian waters soon. The court convened for an urgent hearing on December 26, 2025, at 4:45 p.m. JALDHI Overseas has launched proceedings under Section 5 of the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017, asserting that the owners of 'The Patron' violated the terms of their charter party. According to the claim, the vessel was chartered to carry 75,000 metric tonnes of rock phosphate from Jordan to Paradip. However, the journey encountered significant complications due to an engine failure in August 2025. This mechanical breakdown led to a drastic reduction in speed from the agreed contractual speeds of 12.5 knots when in ballast and 12 knots when loaded, down to just 7.98 knots. Consequently, the vessel's passage from Khor Fakkan to Paradip extended to approximately 21.58 days, far exceeding the anticipated 8.58 days, resulting in financial losses for JALDHI Overseas.
