In a significant legal development, V.Ships Norway A.S. has confessed to breaching the Act to Prevent Pollution from Ships, leading to a hefty penalty of $2 million. This confession relates to unlawful discharges of oily bilge water and waste from the vessel formally known as 'Swift Winchester', which was operating as 'Sea La Bamba'. The company recognized that these discharges were intentionally excluded from the ship's Oil Record Book. From February to August 2022, crew members connected a hose between the incinerator waste oil tank and the sewage holding tank of the tanker. This setup allowed oily waste to circumvent vital pollution prevention devices, resulting in direct ocean discharges. A whistleblowing engine crew member brought these infractions to light by reporting them to a V.Ships Superintendent, who later discovered oil accumulation in the sewage tank during an investigation. Following this, the Chief Engineer was fired. In a related episode in August 2022, the new Chief Engineer instructed the engine crew to clean the oil water separator filter. Instead of following proper disposal methods, the crew washed the filter on deck using degreaser, allowing oily waste to drain overboard through a scupper. These illegal practices were exposed when inspectors from the Marine Safety Unit Port Arthur of the U.S. Coast Guard conducted an inspection. During this investigation, an engine room crew member revealed the discharges, providing photographic and video evidence. The 'Swift Winchester' docked in Baton Rouge, Louisiana, on August 25, 2022, and then in Port Arthur, Texas, on September 7, 2022, all while carrying a falsified Oil Record Book. The investigation was led by the U.S. Coast Guard Marine Safety Unit Port Arthur and the U.S. Coast Guard Investigative Service, with prosecutors from the Environmental Crimes Section of the Eastern District of Texas and the Middle District of Louisiana overseeing the case.
