Dockworker Seeks $5.2 Million in Lawsuit Following Coal Pier Collision Incident
A significant legal battle has emerged in the maritime sector as a dockworker from CSX Transportation, David Rienas, has launched a lawsuit against a shipping company for $5.2 million. The case stems from a serious incident that occurred in August 2012, when the vessel Wawasan Ruby collided with the Curtis Bay pier, impacting Rienas's capacity to work. According to reports published by The Baltimore Sun on February 19, 2013, Rienas, 42, was operating a coal loading machine on the Bayside Coal Pier at the time of the accident. The collision reportedly caused the machine to be violently dragged down the pier, resulting in severe injuries to Rienas's back, neck, and ribs. The lawsuit highlights claims of incompetence against the crew of the Wawasan Ruby, which is owned by Panama-based Trio Happiness SA. Allegations include speeding, inadequate lookout, and failure to utilize radar effectively. Rienas asserts that the injuries he sustained have led to lasting physical and emotional trauma, including mental anguish, distress, and disfigurement. Furthermore, he plans to pursue additional compensation against the vessel under maritime law.
Significant Damage to CSX Coal Pier in Baltimore Following Wawasan Ruby Allision
In a substantial maritime incident, the CSX Corporation's coal pier located in Baltimore has been rendered out of commission following a collision with the tanker ship 'Wawasan Ruby' on August 25, 2012, at approximately 12:40 p.m. The incident occurred at the Bayside Coal Pier, situated on Benhill Avenue in Curtis Bay, as the tanker was navigating towards a dock further up the channel. During this unfortunate event, one employee sustained injuries and was hospitalized, though he was later released. Reports indicate that the 'Wawasan Ruby,' while en route from the Chesapeake Bay to the Bitumar Asphalt Dock, appears to have deviated from the designated channel during a turn, leading to the impact. The collision inflicted over $5 million worth of damages, affecting both property and revenue streams, and rendered the coal pier alongside its loading equipment completely inoperable. Thankfully, the other pier at the Curtis Bay coal facility, designated for smaller vessels, was not affected by the accident. CSX is currently assessing the necessary repairs for the Bayside Pier and is actively collaborating with customers to arrange alternative delivery options in the interim. Although the timeline for repairs remains uncertain, estimates suggest that the work could take anywhere from three to four months. The shipping community has been advised by Inchcape Shipping Services not to anticipate a swift reopening of the facility. In a precautionary measure to secure potential claims for damages, CSX obtained a court order that temporarily detained the 'Wawasan Ruby.' However, the U.S. District Court in Baltimore permitted the vessel to proceed to Antwerp on August 27, contingent upon its owner providing a letter of undertaking to guarantee compensation in the event that CSX prevails in its legal claims. Investigations into the accident have thus far indicated no defects with the vessel, nor any errors on the part of the crew, according to legal representation for the ship and its owner. Notably, the vessel was under the supervision of a member of the Association of Maryland Pilots at the time of the incident. Additionally, an inspection conducted by the Coast Guard immediately following the accident also concluded that there were no issues with the vessel.
