Captain of Tanker 'Peter Paul' Receives Suspended Sentence Following Collision with Fishing Vessel in Bay of Biscay

The 16.30-meter fishing boat was tragically struck by the 'Peter Paul', which was carrying methanol and operated by an Indian crew. At the time of the accident, the watchman aboard the 'Rupella' failed to notice the approaching tanker on the port side. An alarmingly quick turnaround unfolded as one of the fishermen, who had been asleep, rushed to the bridge upon awakening, only to witness the 'Peter Paul' leaving the scene without establishing any communication. Fortunately, with the assistance of a favorable tide, the fishing vessel 'Rupella' managed to return to its home port in Cotinière, Oléron, several hours after the collision. In the meantime, the Indian crew members aboard the 'Peter Paul' promptly notified the captaincy in Bordeaux about the incident. The 'Peter Paul', making its way from Bilbao, had traversed the Bay of Biscay and was within the waters of Bordeaux when the accident occurred. This led to both captains being summoned by the Maritime Chamber of the Tribunal de Grande Instance in Bordeaux to address a violation of the Convention on the International Regulations for Preventing Collisions at Sea (Colreg), primarily concerning priority rules. The prosecution, represented by Nathalie Mathieu, sought a total of 10 months of suspended imprisonment for both captains involved. Ultimately, it was determined that only the captain of the 'Peter Paul' would serve an eight-month suspended sentence, underscoring the legal implications that can arise from maritime navigation errors.
