In the afternoon of Aug 16 French prosecutors decided not to commence legal proceedings against the "Blue Creek" which had been suspected of having left a legacy of pollution of several kilometers. A trail of what looked like oil was photographed on Aug 14 afternoon by the crew of an aircraft, 74 km off Penmarc'h. The ship was then ordered to divert to Brest, where it arrived Aug 15 morning. Initially, the prosecutors had asked for a deposit of € 500,000 of the shipowner, before changing their minds. A visit on board has revealed a design flaw of the separator for used oil.
